1. Introduction
Welcome to FixMyGadgets®. These Terms and Conditions govern your use of our platform and services. By accessing or using FixMyGadgets®, you agree to be bound by these terms.
FixMyGadgets® is a technology platform that connects customers seeking repair services with independent service partners. We do not directly provide repair services but facilitate the connection between customers and partners.
2. Definitions
- "Platform" refers to the FixMyGadgets® website and mobile applications.
- "Customer" refers to individuals who request repair services through the Platform.
- "Partner" refers to independent service providers who offer repair services through the Platform.
- "Services" refers to repair services offered by Partners through the Platform.
3. User Accounts
To use certain features of our Platform, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
4. Services and Booking
When you book a service through FixMyGadgets®:
- You are entering into a direct agreement with the Partner for the repair services
- FixMyGadgets® acts as an intermediary and is not a party to this agreement
- Service availability depends on Partner availability in your area
- Prices displayed are estimates and may vary based on actual diagnosis
5. AI Assistant
Our Platform includes an AI-powered assistant to help with customer support and repair guidance. By using the AI assistant, you acknowledge and agree that:
- The AI assistant provides automated responses generated by Amazon Bedrock (Amazon Nova Pro model) and is not a substitute for professional repair advice
- Responses are generated based on general knowledge and your conversation context; they may not always be accurate or applicable to your specific situation
- Chat messages are stored temporarily (up to 24 hours) for session continuity and are automatically deleted thereafter
- The assistant may use your current page context and, for logged-in users, active booking information to provide more relevant responses
- FixMyGadgets® is not liable for any actions taken based on AI assistant recommendations
- If the assistant detects that your issue requires human attention, it will offer to escalate to our support team
6. Location and Weather Features
Our Platform may offer location-aware and weather-based features. By using these features:
- Geolocation: The Platform may request access to your browser's geolocation API. This is entirely optional and used solely to fetch local weather data for contextual suggestions
- Weather data: We use the Open-Meteo API (a third-party weather service) to fetch weather information. Weather data is cached in your browser session and is not stored on our servers
- Fallback: If you deny geolocation permission, a default location (Mumbai) is used for weather features. The Platform functions fully without location access
- You can revoke geolocation permission at any time through your browser settings
- FixMyGadgets® is not responsible for the accuracy of weather data provided by third-party services
7. Interactive Features and Mascot
Our Platform includes an interactive mascot character that provides visual engagement and contextual suggestions:
- The mascot's animations (eye tracking, expressions, movement) are processed entirely on your device — no interaction data is sent to our servers
- Mouse and touch position data used for eye-tracking animations never leaves your browser
- Contextual suggestions displayed by the mascot are generated locally based on the current page, time of day, and weather conditions
- You may dismiss or ignore the mascot at any time; it does not affect Platform functionality
8. Partner Responsibilities
Partners registered on our Platform agree to:
- Provide services professionally and in a timely manner
- Maintain necessary qualifications and certifications
- Use genuine parts and follow industry best practices
- Honor the warranty terms for services provided
- Comply with all applicable laws and regulations
9. Payments
Payment terms for services:
- Payment is made directly to the Partner after service completion
- Partners may charge assignment fees as displayed on the Platform
- FixMyGadgets® does not handle payments between Customers and Partners
- Any disputes regarding payment should be resolved directly between the parties
10. Warranty
Warranty terms are set by each individual Partner and may vary:
- Warranty coverage, duration, and scope are determined by the Partner who performed the repair
- Customers should confirm warranty terms with the Partner before the repair begins
- Warranty claims should be raised through the Platform for facilitation
- FixMyGadgets® acts as an intermediary to facilitate communication but is not responsible for warranty fulfilment — the Partner bears sole responsibility
11. Limitation of Liability
FixMyGadgets®'s liability is limited as follows:
- We are not liable for the quality or outcome of services provided by Partners
- We are not responsible for any damage to devices during repair
- Our maximum liability shall not exceed the assignment fee paid
- We are not liable for any indirect, incidental, or consequential damages
12. Intellectual Property
All content on the FixMyGadgets® Platform, including logos, text, graphics, and software, is the property of FixMyGadgets® or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our prior written consent.
13. Account Suspension, Termination & Removal
FixMyGadgets reserves the right, at its sole discretion and without prior notice, to:
- Suspend your account temporarily if we detect suspicious activity, unauthorized access attempts, or potential security threats.
- Block your access to the Platform if your account is found to be involved in fraudulent activity, spam, bot-generated registrations, or abuse of Platform services.
- Terminate and permanently delete your account, including all associated data (repair requests, chat history, payment records, gadget information, and any other data linked to your account), for violation of these Terms, misuse of services, or any reason we deem necessary to protect the Platform and its users.
Grounds for account action include, but are not limited to:
- Providing false, misleading, or fraudulent information during registration or service use.
- Creating multiple accounts, bot-generated accounts, or accounts with fake identities.
- Attempting to exploit, manipulate, or circumvent Platform features, pricing, credits, referral systems, or promotional offers.
- Engaging in abusive, threatening, or inappropriate behavior towards other users, partners, or FixMyGadgets staff.
- Violating applicable laws, regulations, or third-party rights while using the Platform.
- Failure to pay for services rendered or engaging in payment fraud.
- Remaining inactive for an extended period (accounts inactive for over 12 months may be subject to removal).
Effect of termination: Upon account termination, all rights granted to you under these Terms will immediately cease. Any outstanding credits, balances, or pending payouts may be forfeited. FixMyGadgets shall not be liable for any loss of data or content resulting from account termination.
Voluntary termination: You may request to terminate your account at any time by contacting us at support@fixmygadgets.in. We will process your request and delete your data in accordance with our Privacy Policy.
14. Changes to Terms
We may update these Terms and Conditions from time to time. We will notify you of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new terms.
15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
